1. Our Services

• Ember Migration provides migration advice, visa application assistance, and education counselling.

• All services are delivered in accordance with the Migration Agents Registration Authority (MARA) Code of Conduct and professional obligations as a Qualified Education Agent Counsellor (QEAC).

• While we provide professional advice and representation, we cannot guarantee the outcome of any application, as decisions are made solely by government authorities and institutions.

2. Client Responsibilities

You agree to:

• Provide complete, accurate, and truthful information and documents.

• Inform us promptly of any changes to your circumstances that may affect your matter.

• Pay agreed fees and charges within the required timeframes.

• Cooperate with us to enable the timely preparation and submission of your application.

Failure to provide accurate or timely information may impact the success of your application.

3. Fees and Payments

• Fees for services will be outlined in a written agreement or invoice before work commences.

• Government application fees, translation costs, and other third-party charges are separate and your responsibility, unless otherwise stated.

• Payments must be made by the due date. We reserve the right to suspend services where payments are outstanding.

4. Confidentiality and Privacy

• We handle all personal information in accordance with our Privacy Policy, the Privacy Act 1988 (Cth), and the Australian Privacy Principles (APPs).

• If you are located in the EU or UK, GDPR protections also apply.

• We are committed to MARA and QEAC standards for the secure handling of client records.

5. Limitation of Liability

• We will provide services with due care and skill, consistent with professional standards.

• To the extent permitted by law, we are not liable for:

  • Decisions made by government bodies or educational institutions.

  • Delays, losses, or outcomes beyond our control.

  • Indirect or consequential loss arising from the use of our services.

• Nothing in these Terms excludes your rights under Australian Consumer Law.

6. Intellectual Property

• All materials, guides, and resources provided by us are protected by copyright and remain our property.

• You may use these materials only for your personal, non-commercial purposes related to your migration or education application.

7. Termination

• Either party may terminate services by written notice.

• If services are terminated, you remain responsible for payment of fees for work completed up to the date of termination.

• We reserve the right to terminate services if you breach these Terms, provide false information, or fail to cooperate.

8. Governing Law

These Terms are governed by the laws of Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Australia.

9. Updates to Terms

We may update these Terms from time to time. The latest version will be published on our website and apply from the date of posting.
